Terms and Conditions of Sale

1. General Terms

These terms and conditions ("Terms") govern your use of the website operated by Cole Buxton Limited, a company registered in England under company number 11236451 with its registered office at Unit 3 123-125 Kensington High Street, London, England, W8 5SF. ("we," "us," or "our"). By placing an order, you agree to be bound by these Terms.

2. Ordering and Availability

2.1. Product Display: We make every effort to display the colours and details of our products as accurately as possible. However, the colours you see depend on your computer monitor, and we cannot guarantee that your display will accurately reflect the product's actual colour.

2.2. Product Availability: All products are subject to availability. While we aim to keep our website up to date, we cannot guarantee that all items shown will be in stock at the time you place your order. If a product you have ordered is unavailable, we will contact you promptly to offer a substitute or a full refund.

2.3. Prices: All prices are subject to change. The price applicable to your order is the price displayed on the website at the time your order is accepted. Shipping costs are charged in addition to the product price.

2.4. While we take every care to ensure pricing is accurate, technical or human errors may result in products being listed at an incorrect price (e.g., £0.00).

  1. Invitation to Treat: The display of products and prices on our website constitutes an 'invitation to treat' and not a legally binding offer.

  2. Contract Formation: A legally binding contract is only formed between Cole Buxton and you (the customer) when we have processed your order and dispatched the goods. An order acknowledgement email sent prior to dispatch does not constitute acceptance of your order.

  3. Right to Cancel: In the event that a product is listed at an incorrect price due to a typographical error or an error in pricing information received from our suppliers, we reserve the right to decline or cancel any orders placed for the product. This applies regardless of whether the order has been confirmed or your payment method has been charged.

  4. Refunds: If your payment has already been processed for a purchase that is subsequently cancelled due to a pricing error, we will issue a full refund to your original payment method immediately."

3. Payment

3.1. Accepted Methods: We accept payments via VISA, MasterCard, American Express, Euro Card, and PayPal. All transactions are processed through our secure payment partners, Stripe and PayPal.

3.2. Security: To ensure the security of your personal and financial information, all payment transactions are encrypted using Secure Socket Layer (SSL) technology. We do not store your full credit card details.

3.3. Payment Timing: Full payment for your order, including any shipping charges, will be charged when your package is dispatched from our warehouse.

4. Shipping and Delivery

4.1. Shipping Charges: Shipping charges will be calculated and added to your order during the checkout process. Please refer to our separate Shipping Policy for detailed rates and delivery times.

4.2. Delivery Times: We aim to dispatch all orders promptly. However, delivery times are estimates and may vary, especially during sale periods or holidays. Please allow an additional 2-5 business days for delivery during peak times.

4.3. Uncollected Packages: It is your responsibility to collect packages from the designated delivery point. We will not be responsible for paying re-delivery costs for uncollected or undeliverable packages due to incorrect details provided by you.

4.4. International Shipping and Import Duties:

  • EU and US: For orders shipped to the EU and the US, we send them on a Delivered Duty Paid (DDP) basis. This means we are responsible for and will pay all import duties and taxes on your behalf. There will be no extra charges for import duties or VAT upon delivery. Please note that due to recent changes in US trade policy, there may be additional duty applied at checkout. We are monitoring this situation closely and will keep you updated as soon as possible.

  • Other Countries: For orders shipped outside the UK, EU, and US, you are responsible for paying any and all import duties, customs fees, and value-added taxes (VAT) imposed by the destination country's customs authorities. We cannot be held responsible for the time it takes for your order to clear customs. We always provide the correct paperwork, but you are responsible for paying any applicable import charges.

    Delivery to Multi-Occupancy Buildings & Communal Areas

  • 4.5 Risk and Possession: In accordance with the Consumer Rights Act 2015, the risk of loss or damage to goods passes to you when the goods come into your physical possession or the physical possession of a person or location identified by you to take possession of the goods.

  • 4.6 Apartment & Business Addresses: If your delivery address is a flat, apartment, office, or other multi-occupancy building, you acknowledge that couriers may be unable to access your individual front door. By providing such an address, you expressly identify and authorise that delivery may be made to the building’s communal reception, concierge, mailroom, or a secure communal entryway.

  • 4.7 Authorised Delivery Point: Delivery to any of the locations mentioned in clause 4.2 shall be deemed as delivery to a "person [or place] identified by the consumer" under Section 29 of the Consumer Rights Act 2015. Once the courier provides photographic proof of delivery or GPS confirmation to that communal area, the goods are deemed to be in your physical possession, and Cole Buxton Limited shall not be liable for any subsequent loss, theft, or damage.

  • 4.8 Secure Alternatives: If you do not wish for your parcel to be left in a communal area, we strongly recommend selecting a DPD Pickup Point or Locker Service at checkout, where the goods will be held securely until you personally collect them.

5. Returns and Refunds

5.1. Right to Cancel: Under the Consumer Contracts Regulations 2013, you have a statutory right to cancel your order and return an item for a full refund within 14 days from the day you receive the goods.

5.2. Refunds: If you return an item, you will be refunded the full price of the product and the original shipping costs. Please note that any import duties and taxes paid at checkout on a DDP basis are non-refundable, as these fees are paid directly to the customs authorities of the destination country.

5.3. Returns Process: To initiate a return, you must notify us of your intention to return the goods within the 14-day period. Please contact us at info@colebuxton.com to receive instructions for your return. If your order is within the EU then you have the right to withdraw your order automatically using the 'withdraw order' in the footer.

5.4. Condition of Goods: Returned items must be in their original condition, unworn, and with all tags attached. We reserve the right to refuse a refund if the goods are not returned in a saleable condition.


 

6. Copyright and Intellectual Property

All content on this website, including all text, images, designs, logos, and product photography, is the exclusive property of Cole Buxton Limited and is protected by copyright and other intellectual property laws. Unauthorized use, reproduction, or distribution of this material is strictly prohibited. Violators will be subject to legal action.

7. Disclaimer of Liability

7.1. Website Operation: We do not guarantee that our website will be uninterrupted or error-free. We shall not be liable for any damage or loss resulting from the use of, or inability to use, our website.

7.2. Product Liability: Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded by law.

7.3. General Liability: We are not responsible for any losses that were not foreseeable to you and us when your order was accepted.

 


 

8. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the English courts.
